Friends of Ritchie report, “He could have hugely boosted his bank balance and set himself up for life, but he already feels he has enough money. He also didn’t want the whole thing dragging on in the public gaze for months and months and, in any case, his priority was the children’s future.”

It is also reported the couple’s two sons will share their time between London and New York. The Times reports, “The 50-year-old singer had wanted all the children to live with her in New York. But her husband had wanted his sons to remain in London, so it appears she has given ground over the children’s future.”

Madonna’s daughter, Lourdes, is not Ritchie’s child and was not adopted by him, and therefore he has no legal right to custody or visitation regarding Lourdes. It appears Ritchie gave on the money portion of the fight in exchange for reaching a deal regarding custody on the couples two sons. There have been reports that Ritchie disagrees with Madonna’s views on child rearing. Parents often have difficulty accepting that once they divorce, they have little to no say in what goes on when the child is with the other parent (unless it’s illegal or abusive). But day to day issues such as bedtime, meals, and toys/ games that the child plays with are impossible to control, and that can lead to a lot of frustration when parents differ on those issues. Rithcie ensured that he has integral part in raising the boys by making a deal where he has an equal share of parenting time with Madonna.

The couple were married in 2003. Matenopoulos works for E! Entertainment’s Daily 10 and Faires is President of Music at Lionsgate. Faires filed on grounds of irreconcilable differences and has requested the court to not give his wife any spousal support. It is unknown if the couple have a prenuptial agreement.

Individuals are entitled to a divorce whether or not the other party agrees to it. The other party does not have a choice if their spouse files for divorce. Obviously the better way to handle the situation is to have the courtesy to let your spouse know that you are filing so that they are not completely blindsided.

Friends of the married couple report to the Post the couple did not have a prenuptial agreement. “Nancy, who has yet to hire lawyers, is said to be preparing to fight for a huge hunk of Henry’s cash as “she helped him build his business. She was with him when he had nothing.” Henry’s lawyer declined comment. A pal of Henry’s said, “Listen, he’s a great guy. And sometimes as people get older they just want to live their lives and be happy.”

New York is one of the few states left where there are no “no fault” grounds for divorce. Therefore, you still have to have grounds to divorce, for example; adultery, cruel treatment, or abandonment. While the legislature has in recent years considered adding “no fault” grounds for divorce, no such legislation has passed. The basic argument against allowing “no fault” divorces is that it will encourage people to get divorced because it will be too easy. The argument for “no fault” divorce is it provides people a method of divorce where they do not have to spend time and money proving the other party is at fault, which can allow for a more amicable and less expensive proceeding.

According to the court papers, Bonaduce reportedly earns $500,000 a year from his job as a radio personality with CBS. The court decided he should pay $6,000 per month for support for his two children and $10,000 a month in alimony to his former wife.

People.com reports, “The 49-year-old former star of The Partridge Family, who became a reality show star and radio host, also will split many of his assets with ex-wife – and Breaking Bonaduce costar – Gretchen.”

The couple aired many of their marital issues on their reality show. Gretchen filed for divorce in 2007. It appears that despite Bonaduce’s substance abuse issues, which were covered in detail in the couples reality show, have been addressed and were not an issue regarding custody. It is important for parents to remember that although they may have past issues with drugs or alcohol, if they can show the court the issues have been, or are being, addressed, it will not prevent them from getting custody or liberal visitation.

Newsday reported the boy’s mother, Shaniqua Tompkins, claimed she was worried about the boy’s safety after the fire destroyed the mansion where they were living and disputed the child’s custody arrangements. Tompkins has been questioned regarding the cause of the fire. After the hearing she stated, “despite my feelings for Mr. Jackson, that’s Marquise’s dad, I want him to have a positive relationship with his dad.” According to TMZ, she also went on to say this was just PR on the part of 50 Cent, referring his sporadic relationship with his 11 year old son.

In general, non-custodial parents who do not live in the same area as their child do not get as much visitation as parents who are local. On the one hand, a parent should have the opportunity to pursue their career wherever it may take them. And often, they may have no choice but to relocate because they need a job. But on the other hand, the reality is that if you don’t live near your child, the time and cost for most parents to visit their child prohibits it from occurring on a frequent basis. Either way, it can be a tough choice for a parent to make.

Fortunato, the 46 year old former New York school teacher, will receive at least $5 million according to the couple’s prenuptial agreement. The pre-nup is said to be iron-clad and the LA Times reports that is $1 million for every year of the marriage.

The couple claims to be parting amicably, but those close to the couple have said the they have had problems for the past year and Redstone asked Fortunato to leave their LA mansion. Redstone’s family is also said to be very happy about the split from the much younger Fortunato.

In this case, the prenuptial agreement worked to both parties advantage. Not only did it save them both time and money, but the recent turbulence in the financial markets has had a negative impact on Redstone’s fortune. It is probable that the recent decline in his net worth encouraged both parties settle quickly, in that Redstone wants to focus on shoring up his financial status, and Fortunato likely saw no point in trying to contest the prenup if Redstone’s net worth is less than what is was when they got married.

It is not known whether the couple have a prenuptial agreement but sources close to the couple say they would like to avoid the tabloid fodder of the McCartney-Mills divorce. Madonna, who is estimated to be worth over $300 million, could stand to lose a substantial amount, especially if the divorce is filed in England where the couple reside. The Telegraph reports, “Margaret Hartwood of law firm Thomas Eggar urged them to go down the collaborative route …There are cases where wealthy women have been required to pay men substantial sums of money and the court will be completely neutral over the fact that the woman in this case holds most of the wealth. However, Mr. Ritchie may have male pride issues which prevent him from making a claim.”

Madonna may, however, create quite a battle if she files in New York, where she has an apartment in Manhattan. The battle over jurisdiction could take a substantial amount of time and it is rumored the Material Girl wants it over by Christmas.

Usually when you file for divorce you have to file in the county where the Defendant resides. However, in situations where a couple own several homes in different states, or countries, where a person resides can be open to interpretation. There are also other circumstances that can effect where you file, such as if you do not know where the other party is, or if you have children, where the children are living.

It looks like this is yet another couple who got married without a prenuptial agreement. Although they may not have had the assets ten years ago that they have now, being in the business they should have known how things can turn around. Having the foresight to get a prenuptial agreement would have saved them both a lot of time and money.

Per the Atlanta-Journal Constitution, Holyfield had until Sept. 1 to pay $4,500 in attorney’s fees that the mother ran up in getting him to pay back child support and to ensure that a college trust fund is in place and funded. Neither condition had been met as of Monday afternoon. Holyfield has also failed to pay the child’s private school tuition, forcing the mother to instead send her son to public school.

Holyfield also has eight other children for which he has to pay child support, and according to the AJC, he spends nearly $500,000 annualy in child support. He also has two children with his current (third) wife, Candi.

Holyfield’s lawyer, Joy Edwards, did not comment on the current case but hinted to a solution in the works.

In family law contempt cases, the court has the option of finding a party in willful contempt and putting them in jail. Court’s will often use this option when it is apparent the party has the means to pay what is owed, and is just not willing to do so. Often a court will jail a party and give them the opportunity to get out of jail by purging themselves of the contempt by paying what is owed.

Woelfe is now petitioning the court for more support and visitation for the child with Buckley. Buckley’s father recently died and he stands to inherit millions from his father’s estate, estimated at more than $30 million. Woelfe contends the boy is suffering from attention deficit hyperactivity disorder and that the child will benefit from a private school education and contact with his father.

According to papers filed in the case, “As Jonathan gets older, he requires love, attention and a notable involvement in his life from his father,” the lawsuit said. “It is in Jonathan’s best interest and welfare for this court to impose a contact and access schedule on the Father, so that Jonathan can establish a relationship with his Father and extended paternal family.”

It also sounds like Buckley’s millionaire father purposefully distanced himself from the “other” grandchild. William Buckley’s will read, “I intentionally make no provision herein for said Jonathan, who for all purposes … shall be deemed to have predeceased me.” He left his entire estate to his son and his other two grandchildren.

To modify child support, you have to show a substantial change in income of either parent and/or a substantial change in the needs of the child. Woelfe’s petition seeks to meet both of those requirements by stating that Buckley has had a substantial change in income based on his inheritance from his father, and that the child has special needs which would be attended to by a private school education. Regarding the visitation, it can be very frustrating when the non-custodial parent does not exercise visitation with the child. However, you can not require the non-custodial parent to exercise visitation. Unfortunately if a parent decides they do not want a relationship with their child, there is no way to legally require them to have one.
